This Legal Notice regulates the conditions of use and browsing of the Web Platform https://www.escuelasuperiordemusicareinasofia.es/ (hereinafter, the Platform”).

Accessing, browsing, and using the Platform implies holding the status of user thereof (hereinafter, “the user”) and, consequently, the express and unreserved acceptance by the user of all the terms and conditions contained in this Legal Notice, for which reason we recommend reading it carefully. If you do not agree with it, as with the privacy and cookie policy to which it is subject, simply do not accept it through the means enabled for this purpose, which will make it impossible to use the Platform, the services, and functionalities available through it.

 

1. GENERAL INFORMATION

In compliance with the provisions of Law 34/2002, of July 11, on information society services and electronic commerce, the owner of the Platform is the Albéniz Foundation (hereinafter, “Albéniz Foundation” or “we”), an entity with Tax Identification Number G-39067806, located at Plaza de Oriente, s/n, C.P. 28016 in Madrid, and registered in the Single Registry of Foundations of state competence, registered with nº 104CUL.

1. ACCEPTANCE OF THE CONDITIONS OF USE

Access to all the functionalities available on this Platform implies acceptance of each and every one of these conditions, as well as any other that may be established, modified and/or expanded due to present or future service needs.

The Albéniz Foundation shall be entitled to modify the content of these conditions at any time, as well as the services and functionalities available through the Platform, with the publication of such changes and modifications through this medium being deemed sufficient, without prejudice to the user’s possibility of accepting or not such modifications. In case of non-acceptance, this may determine that the use of the Platform and all or some of the functionalities available through it is prevented.

 

3. CONDITIONS OF ACCESS AND USE

The user undertakes to make appropriate and lawful use of the Platform, as well as the contents, products and services available from it, in accordance with the legislation applicable at any time, these conditions, morality and generally accepted good customs and public order.

In general, access to and use of the Platform is free. However, certain parts of the Platform have restricted access through a username and password that will be assigned to you and that you can modify at any time, being responsible for its safekeeping and its transfer to unauthorized third parties being strictly prohibited.

Therefore, the user is obliged to adopt the necessary security measures to maintain the confidentiality of the systems or access and verification codes established in relation to the Platform, so the Albéniz Foundation will be released from any liability to that effect for negligence, carelessness or misuse by the user or any third party in this area.

4. INDUSTRIAL AND INTELLECTUAL PROPERTY.

The user acknowledges and accepts that all industrial and intellectual property rights over the contents and/or any other elements inserted in the Platform (including without limitation, trademarks, logos, trade names, texts, images, graphics, designs, sounds, databases, software, presentation, audio and video, if introduced), are the exclusive property of the Albéniz Foundation or third parties that have specifically authorized the Albéniz Foundation for this purpose.

In no case does access or browsing through the Platform imply any type of waiver, transmission, license or total or partial assignment of said rights, unless expressly stated otherwise in writing.

All intellectual and industrial property rights over the contents and/or services of the Platform are reserved and, in particular, it is prohibited to modify, copy, reproduce, publicly communicate, transform or distribute, by any means and under any form, all or part of the contents included therein for public or commercial purposes, if there is no prior, express and written authorization from their respective owners.

The user who violates these limitations and prohibitions acknowledges assuming exclusively any responsibility in this regard, holding harmless the Albéniz Foundation or any other third party that may be affected as a result of the user’s action.

 

5. PROCEDURE IN CASE OF VIOLATION OF INTELLECTUAL PROPERTY RIGHTS.

In the event that any user or a third party considers that any of the contents has been introduced in the Platform in violation of their intellectual property rights, please immediately notify the Albéniz Foundation (Plaza de Oriente, s/n, C.P. 28016 in Madrid, or fundacion@albeniz.com) of this circumstance, with complete and precise indication of their data and the intellectual property rights allegedly infringed.

 

6. EXCLUSION OF GUARANTEES AND RESPONSIBILITY.

The Albéniz Foundation does not guarantee the availability and continuity of the Platform’s operation. Likewise, it will not be liable in any case for any damages that may arise from:

The absence of viruses or other elements in the Platform introduced by third parties unrelated to the Albéniz Foundation and that may cause alterations in the physical or logical systems of users or in the documents, files and files stored in their systems is not guaranteed.

The Albéniz Foundation will adopt various measures to protect the Platform and the contents against computer attacks by third parties. However, it does not guarantee that unauthorized third parties cannot have access to the type of use of the Platform made by the user or the conditions, characteristics and circumstances in which said use is made. Consequently, it will not be liable in any case for damages that may arise from such unauthorized access.

The Albéniz Foundation reserves the right to suspend without prior notice access to users who, in its opinion, fail to comply with the rules of use of the Platform and to exercise the appropriate legal measures, without this generating any right to compensation in favor of the user who may be affected by it.

The Albéniz Foundation will not be responsible in any case for the use that users and/or third parties may make of the Platform, nor for the damages that may arise from it.

The Albéniz Foundation excludes any liability for damages of any nature that may be due to the use of the services and content by users, or that may be due to the lack of information, accuracy or lack of veracity of the information they provide in the framework of the Platform and the Service, and in particular, although not exclusively, for damages of any nature that may be due to the impersonation of a third party carried out by a user in any kind of communication or action carried out through the Platform.

The function of the links, which may appear on this Platform is exclusively to inform the user about the existence of other sources of information, where they can expand or complete the data offered on this site. The Albéniz Foundation will not be responsible for the result obtained through these links.

In any case, the Albéniz Foundation does not assume any responsibility derived from the contents linked from its Platform, nor does it guarantee the absence of viruses or other elements in them that may cause alterations in the computer system (hardware and software), in the documents or files of the user, excluding any responsibility for damages of any kind caused to the user for this reason.

In the event that any user or a third party considers that the content or services provided by the linked websites are illegal, violate constitutional values or principles, or harm property or rights of the user or a third party, please immediately notify the Albéniz Foundation (Plaza de Oriente, s/n, C.P. 28016 in Madrid, or fundacion@albeniz.com) of this circumstance.

 

8. JURISDICTION AND APPLICABLE LAW.

Any dispute in relation to this Legal Notice shall be substantiated before the Spanish jurisdiction, expressly agreeing the parties to submit to the jurisdiction of the Courts and Tribunals of the city of Madrid, unless the applicable regulations establish the competence of other Courts and Tribunals for these purposes.
